Abstract (2. Language): 
The reason for studies on formation of collective agreements without party wills in industrialized market economy countries with developing collective agreement concept, such as England, USA, Canada, Japanese, Sweden, Germany, France and Italy is that; although each of them have specific institutional regulations, they share some common elements in politic and economic sense and they carry the nature of being a model in their capacity. In western countries the leading opinion is that the governments shall not interfere in the autonomy of collective agreements and that the regulation of working conditions must be left to the mutual wills of the parties. On the other hand in many countries governments occasionally intervene the freedom of collective agreements in temporary and permanent means by way of not leaving the disputes lead up to strikes and occasions happen when collective agreements are concluded by will of a third person other than the parties.

Toplu pazarlığın geliştiği piyasa ekonomisine sahip İngiltere, Amerika Birleşik Devletleri, Kanada, Japonya, İsveç, Federal Almanya, Fransa ve İtalya gibi sanayileşmişülkelerde toplu işsözleşmesinin taraf iradeleri dışında oluşmasının incelenmesinin nedeni, bu ülkelerin kendilerine özgü farklı kurumsal düzenlemelere sahip olmakla birlikte sosyal, politik ve ekonomik alanda bazı unsurları ortaklara paylaşmaları ve model olabilme niteliğine sahip olmalarıdır. Batıda toplu işsözleşmesi özerkliğine devlet tarafından müdahale edilemeyeceği ve çalışma koşullarının düzenlenmesinin tarafların karşılıklı iradesine bırakılması gerektiği kabul edilmektedir. Ancak, pek çok ülkede devletin zaman zaman geçici veya kalıcı olarak toplu işsözleşmesi özgürlüğüne müdahale ederek taraflar arasında doğan çıkar uyuşmazlıklarında greve izin vermediği ve toplu işsözleşmesinin tarafların özgür iradesi dışında bir üçüncü kişinin iradesi ile oluştuğu da görülmektedir
