THE STAGES OF TENDER AND CONTRACT AND THEIR DECESIVE ROLE ON THE DISTINCTION OF JURISDICTIONAL DISPUTES IN PUBLIC PROCUREMENT PROCESS

Abstract (2. Language):
Public procurement implies a process of purchasing goods and services and realizing work. This process consists of a tender (procurement) stage and a contract stage. In the tender stage contracting entity does not act as a real person. Contracting entity unilaterally sets the terms of contract and it ascertains the contractor and the price of purchase by following the procedure. Procurement process (tender stage) starts with the approval of the procurement and continues until the signing of a procurement contract. Contract stage begins with the signing of the contract. A direct action for annulment against the transactions for tender stage can not be brought before a court because of first instance a compulsory appeal has to be made to the administrative body. Public Procurement Authority gives a decision on the appeal. Therefore an action for annulment can be brought against this decision. The distinction of private and public law is a base to the two stages of public procurement: tender stage and contract stage. Uniteral procedures within the contracting entity's function are subject to administrative tribunals whereas the procedures regarding to the application of the contract which is covered under private law are subject to ordinary courts. Jurisdictional disputes are resolved according to the procedural law of the court where the action is brought.

Harcama ihalesi, idarenin mal ve hizmet alımları ile yapım işlerini gerçekleştirdiği bir ihale sürecini ifade etmektedir. Bu süreç, ihale ve sözleşme aşamalarından oluşmaktadır. İdare ihale aşamasında özel hukuk kişisinden farklı hareket etmektedir. İdare sözleşmenin koşullarını tek yanlı belirlemekte, sözleşme yapacağı kişiyi ve işin parasal değerini birçok işlemi sırayla takip ederek tespit etmektedir. İhalenin onayı ile başlayan ihale aşaması sözleşmenin imzalanmasına kadar devam etmektedir. Sözleşmenin imzalanmasından itibaren ise sözleşme aşaması başlamaktadır. İhale aşaması işlemleri için tüketilmesi zorunlu idarî başvuru yolu öngörüldüğü için, bu işlemlere karşı doğrudan iptal davası açılamamaktadır. İdarî başvuru süreci sonunda Kamu İhale Kurulu tarafından verilen karar aleyhine iptal davası açılabilmektedir. Harcama ihalesi sürecinin "ihale aşaması" ve "sözleşme aşaması" şeklinde iki kısımdan oluşmasının temelinde, kamu hukuku ve özel hukuk ayrımı yatmaktadır. Dolayısıyla idare işlevinde kalan tek yanlı işlemler idarî yargının, özel hukuk alanında kalan sözleşmenin uygulanması ise adlî yargının konusunu oluşturmaktadır. Yargı yolu uyuşmazlıkları mahkemelerin tâbi oldukları usul hukukuna göre çözümlenmektedir.
